Who we are and what the website uses
The essentials about who is responsible, how to contact us and what happens when you browse the public website.
Fairwood Finance Limited, company number 01407295, is the controller responsible for personal information used through this website, the loan application journey and the records Fairwood creates while considering and managing an application or loan. Its registered office is 456 Gower Road, Killay, Swansea, SA2 7AL.
If you have a question about this notice or your information, use the details on the Contact page or write to Fairwood at its registered office.
When you visit the website, Fairwood and its approved service providers may receive basic technical and security information. This can include an IP address, browser and device details, pages requested, the referring page, date and time, and diagnostic or security events.
The website also stores your cookie choices and the time and version of that decision. If you choose to contact Fairwood by telephone, email or WhatsApp, Fairwood will use the information you provide to respond to you.
Information used to consider an application
What we collect, the checks we may carry out and how Open Banking and credit-reference information may be used.
When you start or submit an application, Fairwood may collect your name, title, date of birth, contact details, contact preferences, current and previous addresses, loan request, loan purpose and whether you are a new or returning customer.
We may also collect information about your income, employment or benefits, residential status, regular spending, recent borrowing, preferred payment method and anything else needed to understand whether the repayment is affordable.
You do not have to tell Fairwood about health, disability, wellbeing or other sensitive circumstances unless you want us to take them into account. If you choose to provide this information, we use it to understand your needs, consider reasonable adjustments and support you fairly.
Access is limited to people who need the information for that purpose. Fairwood will only use special-category information where data protection law allows it, which may include your explicit consent or another condition that applies to the support or legal obligation involved.
Fairwood uses information to receive, review and manage applications; contact applicants and customers; check identity, age, address, fraud risk, creditworthiness and affordability; provide requested support; make and explain lending decisions; and manage any loan that is agreed.
We also use information to keep accurate records, protect the website and application journey, understand repeat attempts, handle complaints, prevent financial crime and meet consumer-credit, responsible-lending, accounting, audit and data-protection obligations.
Sending an application does not mean a loan has been approved. Fairwood may carry out proportionate checks to confirm who is applying, where they live, whether the information is consistent and whether the loan and repayment appear affordable.
Checks may include identity, age, address, service-area, existing-customer, credit-reference, affordability, fraud-prevention, financial-crime, application-consistency, browser or network-risk and Open Banking checks. A risk signal does not automatically mean an application will be declined; it may lead to a closer review or a request for more information.
Fairwood may use credit-reference and fraud-prevention agencies to help verify identity, address, credit history, current borrowing and affordability. A credit search may leave a record on your credit file whether or not a loan is approved.
If a loan is agreed, Fairwood may report account information, including repayment history, missed payments, arrears, defaults or account closure. Credit-reference and fraud-prevention agencies keep and use their own records for their lawful purposes.
Fairwood uses Open Banking to understand income and spending without asking you to provide paper or downloaded bank statements. If Open Banking is needed, we will explain what is required and why before you choose whether to connect your account.
The approved Open Banking provider will present its own connection and consent information. Fairwood will never ask you to disclose your online-banking password to Fairwood or a local agent.
Purposes, sharing and safeguards
The legal reasons for using information, who may receive it, how long it is kept and where it may be processed.
Depending on what Fairwood is doing, we may use information because it is needed to take steps at your request before a contract or to manage a contract; to meet legal and regulatory obligations; or for legitimate interests such as operating a responsible lending business, preventing fraud, keeping records, managing risk and protecting our services where those interests are not overridden by your rights.
Where consent is required, such as for optional marketing, non-essential website technologies or a particular use of sensitive information, consent is the basis for that activity. You may withdraw consent for future use at any time without affecting earlier lawful use.
Fairwood only shares information where it is needed, lawful and proportionate. Recipients may include credit-reference, fraud-prevention, identity, address-checking and Open Banking providers; IT, hosting, communications, payment, evidence and application-management providers; Fairwood's agents, employees, contractors and professional advisers; and regulators, courts, law-enforcement bodies or public authorities where the law permits or requires it.
Information may also be shared with a purchaser, funder or successor if the business or loan book is reorganised, sold or transferred, subject to appropriate confidentiality and data-protection controls.
Fairwood keeps personal information only for as long as it is needed. The period depends on the type of record, why it was collected, whether a loan was made, legal and regulatory requirements, fraud-prevention needs, complaint and audit periods, and the need to establish or respond to claims.
This may include part-completed, declined or withdrawn applications where Fairwood needs to evidence a decision, respond to an enquiry, identify repeat attempts or prevent fraud. Information is deleted or anonymised when it is no longer needed.
Fairwood aims to store and process information in the United Kingdom or with providers that use appropriate safeguards. If information is transferred outside the UK, Fairwood will use a lawful transfer arrangement and assess the protection required for that transfer.
Fairwood may use system checks to help staff review an application, but the final lending decision will not be made solely by automated processing without meaningful human review. If this changes, Fairwood will update this notice and explain the process before using it.
Access, choices and complaints
How to ask a question, exercise a data-protection right, manage cookie choices or raise a concern.
Depending on the circumstances, you may have rights to be informed, receive a copy of your information, correct inaccurate information, ask for deletion or restriction, object to certain processing, receive portable information and challenge certain automated decisions.
Some rights may be limited where Fairwood must keep or use information for a contract, legal or regulatory obligation, fraud prevention, complaint handling or record keeping. You may ask Fairwood to explain how a right applies to your circumstances.
To make a privacy request or ask a question, use the details on the Contact page or write to Fairwood Finance Limited at 456 Gower Road, Killay, Swansea, SA2 7AL. You may also complain to the Information Commissioner's Office if you are unhappy with how your information has been used.
If your concern is about an application, lending decision, customer service, repayment difficulty or another financial-services matter, use Fairwood's separate complaints process.
Strictly necessary cookies and similar technologies support requested functions, remember privacy choices and help keep the website secure. Optional analytics, personalisation or advertising technologies remain off unless you consent to the relevant category. The Cookie notice explains each category and how to change your choices.
Fairwood will not use application contact details for optional marketing unless you have chosen to receive it or the law otherwise permits the contact. You can change your marketing preferences or ask Fairwood to stop at any time.
Fairwood reviews this notice when its services, providers or use of information changes. The current version and review date are shown on this page. If a change would materially affect how Fairwood uses existing information, we will take reasonable steps to bring it to the attention of the people affected before the new use begins.
